They could say "We own MLP and all the imagery and ideas associated with it" and prevent people from using their characters in the Con. I'm pretty sure if they didn't want them they could Cease and Desist Cons if they wanted to.
Well the legal issues there are not clear cut, but the threat of a lawsuit alone would probably stop cons from happening.
