Yeah, I know that a lot of people have bitched about some of the stuff that Hasbro does, but seriously by industry standards they've been incredibly lax in what they allow the fans to get away with. Most other companies would have thrown a conniption over this kind of thing. I mean, let's face it, there are lots of people making good money off of selling plushies and custom figures and stuff that would probably fall under copyright infringment or whatever.
A huge part of that has to do with pretty much the entire studio being in on it. I mean when you have one of your directors being rabidly protective of the fans from day one, the other goes out and buys
this, 
your voice actors gleefully follow suit, and most of your animation staff is unusually active in exposing the guts of the business and mingling with fan artists, there's kind of a vibe that goes through the network and merchandising company not to screw with this setup lest you shoot your own cash pony in the foot by alienating one of your most talented studios. It's something that I haven't really seen this side of the Pacific in pretty much ever — at least not on this scale.
It's also worth noting that Hub is likely
losing money on the whole and FIM is kind of a lifeline for them right now — and as many bronies as go around pirating the episodes, well, we're not helping as much as we should be (one of the reasons I watch them on hubworld when possible). Part of that is that they (and most other channels) need to just go ahead and put up an official Youtube channel so they can capture those viewership numbers, but given the nature of their programming it does present a few problems you wouldn't have for, say, FX. I mean, would
you want your 9-year-old kid to be reading Youtube comments?
It's always kind of boggled me that
they haven't been selling plushies and stuff. I mean, I'd be a heck of a lot more likely to buy something like that plushie (if it didn't cost
$3000 I mean geez) than a plastic figurine, and I'd assume the target audience would be too.
