Would making out with one still be bestiality though?

I'm pretty sure the main legal hubub with such stuff is that animals are not sapient, and thus unable to give consent. Consent is a pretty big deal with that kinda stuff.

Ponies would be sapient and thus able to give consent, so I don't think there would be any legal issues with it. I could be worng though.
